1. Introduction

The website www.mosaicflowers.com ("Website") is edited by Margaux Bastid, registered in Spain, operating through the name Mosaic. The Website is hosted by Squarespace Ireland Ltd., Le Pole House, Ship Street Great, Dublin 8, Ireland.

Through the Website, Mosaic presents and sells Floral art and Events (“Services”) and bouquets (“Products”).

2. Object of the terms and conditions

These following terms and conditions ("T&C") apply without restrictions nor reserve to the entire contents of the Website and to any contract (including sale) concluded through the Website between Mosaic and the physical consumer or legal entity (referred together as the "Client").  

By browsing and using the Website and/or confirming the order, the Client expressly agrees to the T&C.

Mosaic reserves the right to modify the T&C at any time and it is up to the Client to consult them regularly, these modifications taking effect at the time of their publication on the Website. 

The T&C applicable to the order will be the one published on the Website at the time of the order.

The Client expressly states having the legal capacity to contract with Mosaic.

 

3. Use of the Website

The rights, and in particular those of intellectual property, protecting the brands, logos, designs and models, information, texts, images, software, databases and more generally any element of the Website (hereinafter the "Content") are Mosaic's exclusive property.

The Client undertakes not to reproduce or represent, in whole or in part, the Content and/or the Website in any way or for any purpose without Mosaic's prior written authorization.

Any unauthorized exploitation by the Client of the Website and/or the Content may incur civil and / or criminal liability, Mosaic reserving the right to initiate legal proceedings.

Any material downloaded or obtained in any other way during the use of the Website is done at the risk and peril of the Client, which will solely be responsible for any damage suffered on its computer or any loss of data following the downloading of any material. 

Mosaic is not responsible for any problems that may arise due to the Client's IT environment or incorrect configuration of its equipment (technical failure, malfunction of communication networks) or difficulties in connecting to the Internet.

The Client acknowledges and accepts that access to the Website may be suspended or stopped during maintenance work, updating, technical breakdown or violation of automatic data processing systems or difficulties related to the Internet without being able to engage Mosaic's responsibility. 

The Site may contain hypertext links to other websites managed by third parties and over which Mosaic has no control. Consequently, Mosaic can in no way be held responsible for the content, information, products and/or services offered on these websites.

 

4. Presentation of the Products AND SERVICES

Mosaic’s services include

  • Creation of Floral art and Events (“Services”), bouquets (“Products”) and other consumable or perishable products (such as candles and plants);

  • Hire of equipment and decoration (vases, candleholders, furniture);

  • Running of workshops and courses in foral design or retreats on the theme.

 

5. PAYMENT

When contacting Mosaic, the Client will receive

  • Proposal, including creative options, ideas and budget

  • Contract detailing all payment and partnership agreement

 

6. Responsibility

Mosaic cannot be held responsible for the non-performance of the contract concluded in the event of a stock shortage or unavailability of the Product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communication, flood, fire, terrorist attack, lockout.

 

7. Personal Data and Privacy Policy

The personal data of the Clients collected by Mosaic are those collected during the order of the Products, the Floral Art and/or Services.

These data are only used to process orders, proceed with deliveries, manage the Client's account, analyse the orders and, if the Client has expressly chosen this option, send commercial prospecting letters, newsletters, promotional offers and / or information on special sales. 

The data are solely intended for Mosaic. However, the data may be communicated, in whole or in part, to Mosaic's service providers involved in the ordering process (platform payment). 

The Client is informed that it has a right of access, rectification, portability, deletion of its data as well as a right to oppose and limit the processing of its personal data.

The Client may exercise these rights by written request to: hello@mosaicflowers.com.

The Client also has a right to seize at any time the local competent authority for personal data.

 

8. Law applicable

Spanish law will govern any dispute relating to these general conditions of sale, including vis-à-vis foreign customers.
